I mentioned last week that I read the Adult Industry trade magazine, which it is the mouthpiece for the association representing the retailers and wholesalers both in the high street and on line who sell products which are classed as part of the adult industry.

Some of you may be aware that there are strict licensing laws for high street retailers selling what are classified as R18 DVDs. However even traders who do not stock these items appear to be having problems and this seems to be a common theme in the magazine about retailers having problems with local councils who vary in how they interpret and enforce the law regarding the sale of adult goods.

In this months editorial it relates that a trader in York was fined £14,000 by Magistrates. Not for selling R18 DVDs without a licence but “for merely having a larger percentage of adult products on display than his council considered appropriate for an unlicensed store. Apparently council representatives counted hen night novelties, every example of PVC clothing and even some lingerie products and classed them all as sex items. The Industry association feels that such a draconian punishment does not fit the crime. They believe that he was treated ruthlessly in court because he chose to defend himself rather than “playing by the rules and hiring their own band of expensive legal mercenaries”.

I don’t think this relates just to adult industry traders, we are all at the mercy of the legal system this way. I once had to employ a solicitor and a barrister to represent me to get tenants evicted from my house and she was a total waste of space but the reason you employ them is because you assume that they speak the same language as the judge and be able to put your case better than you could.

Anyway back to the story, this trader is going to appeal. Another trader from Belfast was taken to the House of Lords when the council appealed against an earlier ruling in his favour and has now sided with the council. Costs at the moment stand at around £400,00 and this trader is taking his appeal to the European Court of Human Rights which they estimate will properly take about 5 years to go through the system.

These 2 cases are just the tip of the iceberg when it comes to legitimate traders being treated as criminals because of the inherent prejudices that there seem to be in the UK about the “adult industry”. Prurient has had great difficultly in getting a merchant bank account for trading on the internet, because as soon as they see the word “adult” in the description of the companies business they don’t want to touch you with a barge pole. It seems as it unless you are one of the large companies with multi million pound turnovers (where they conveniently forget to take their moral stance) they will not consider you.
